10 July 2008 Legal expert: Drivers should avoid convictions this summer

Stay off the phone behind the wheel, says legal expert. Motorists in the UK should do their best to ensure they do not pick up a motoring conviction this summer, it has been claimed.

According to motoring law specialist Catherine Junor from Higgs & Sons, being caught using a mobile phone can be seen as dangerous driving and as such can carry a two-year sentence.

In addition, it may be that those who pick up a conviction for the crime struggle to take out cheap car insurance policies in the future, as cover companies could view them as a risk.

"It is all too easy to think it is okay to take a quick phone call ... In the eyes of the law however, the use of mobile phones is not allowed at any time," said Ms Junor.

Last year, the Department for Transport increased the punishment for those caught on phones behind the wheel to a £60 fine and three licence points.
