21 July 2006 Bosses will be liable if employee uses phone while driving

 Firms could soon be prosecuted if employees are caught using a mobile phone behind the wheel while on duty.

A ban on the use of handheld mobile phones while driving was introduced in 2003 after research showed they increased the chances of being involved in an accident and having to make a car insurance claim.

However, police hope that by introducing the new policy companies will take the offence more seriously to avoid embarrassment.

"Having a uniformed police constable around the office does not look good for business," says Metropolitan Police Chief Inspector Ian Brooks.

"The scheme is designed to make companies feel uncomfortable when not fulfilling their responsibilities but we will also be there to offer support and guidance in putting a policy in place.

"We are not out to target businesses, only to encourage companies to operate responsibly," he added.

The new law will mean if an employee is caught, he or she will be given a £30 fine before the police visit the employer's premises and meet with a company director.

If the use of the phone leads to a crash the company may face individual or corporate manslaughter charges.

The scheme will initially be trialled in London and if it proves successful, will be rolled out nationwide.
